Introduction

In exercise of the powers conferred by provision to section 4 of the Mental Health Act, 1987 (14 of 1987), the State Mental Health Authority was constituted by Government of Kerala on November 1, 1993 as per the notification No(P) 122 / 93 Health and Family Welfare Department dated 1/11/1993. The state Authority constituted as the above has been reconstituted several time. The last reconstitution of the authority was on 26.09.2013

The Mental Healthcare Act (MHCA) 2017 received the Assent of the President of India on 7th April, 2017 and the Final Rules were notified on 29th May, 2018 by Govt. of India in the Official Gazette. The Mental Health Care Act 2017 was also declared to have come into force on 29.05.2018. In the Chapter VIII (Section 45-56) of Mental Health Care Act 2017, the provisions regarding establishment, composition and constitution, functions of SMHA and other important Sections regarding SMHA have been mentioned.

Ksmha
In exercise of the powers conferred by section 45 and 46 of the Mental Health Care Act, 2017 (Central Act No.10 of 2017) read with rule 3 of the Mental Healthcare State Mental Health Authority Rules, 2018 dated 29th May 2018, issued by the Government of India , Government of kerala, as per the notification GO(P)No.87/2019/H & FWD from Health and Family Welfare Department dated 16/07/2019, constituted the State Mental Health Authority with the following members.
  • Principal Secretary, Health & Family Welfare Department-Chairman (ex-officio)
  • Joint Secretary, Health & Family Welfare Department in charge of mental health- Member (ex-officio)
  • Director of Health Services – Member (ex-officio)
As per Section 52(1) of the Mental Health Care Act, the Mental Health Authority shall have a Chief Executive Officer. Government of Kerala, as per G.O.(Rt)No.2389/2019/H&FWD, Dated. 04/10/2019, is temporarily appointed Dr. Jayaprakashan K.P, Associate Professor, Psychiatry, Government Medical College, Thiruvananthapuram, (former Part time Secretary of the Kerala State Mental Health Authority constituted by the earlier Act) as Chief Executive Officer of the Kerala State Mental Health Authority.
